Multivitamin Fluoride Issue

Endo Pharmaceuticals, and its affiliates including Generics International and Vintage Pharmaceuticals, marketed and sold children's multivitamins with fluoride under a number of names, including Qualitest Multi-Vitamin with Fluoride Chewable Tablets. The tablets came in three dosage sizes - 0.25 mg, 0.5 mg., and 1 mg of fluoride per tablet, with the specific concentration of fluoride disclosed on the product label. Qualitest Fluoride Tablets could only be dispensed with a prescription. The Qualitest Fluoride Tablets purported to deliver a fixed dose of fluoride for those children whose dentists or physicians have determined that supplemental fluoride is necessary for cavity prevention. Specifically, as stated in guidelines issued by the American Dental Association ("ADA"), the American Academy of Pediatrics ("AAP"), and the American Academy of Pediatric Dentistry Pediatricians (the "ADA-AAP Guidelines"), dentists and other healthcare providers prescribe fluoride supplements to children under age 16 prevent tooth decay. The ADA-AAP Guidelines recommend that children living in areas where the water is not fluoridated, or is insufficiently fluoridated, be prescribed fluoride supplements containing fluoride ion. However, from 2007 through July 2013, the Qualitest Fluoride Tablets contained only about 44% of the amount of fluoride claimed on their labels.

There are a number of communities in Texas, as well as other in states including New York, New Jersey, Florida and California, that do not add fluoride to their drinking water supply. If you live in one of those communities, you or your children may have been prescribed Qualitest Fluoride Tablets by your doctor or dentist to provide the fluoride necessary to meet the ADA-AAP Guidelines. If you or someone you know paid for prescription multivitamins with fluoride, you could be part of a class of people who may be entitled to reimbursement.

Spagnoletti & Co. have experience with class action lawsuits, and can help you understand your rights if you or someone you know paid for prescription multivitamins with fluoride because you lived in a Texas or other community without fluoridated water.
