Spagnoletti & Co. Law Firm recently filed suit on behalf of two minors who were injured in when the bus they were on crashed in March, 2018. The two minors were members of the Channelview High School band, returning from a school trip to Florida. The charter bus they were on left the highway, and careened into a 50-feet ravine. Both minors sustained severe injuries as a result. The lawsuit has been filed against First Class Tours, the operator of the charter bus and RJR Leasing.
The lawsuit alleges the Companies were negligent in:
(a) hiring and/or retaining a driver whom it knew or should have known was a reckless or incompetent driver;
(b) entrusting a bus to a driver whom it knew or should have known was a reckless or incompetent driver;
(c) failing to adhere and/or follow federal regulations regarding driver qualification records, including the investigation, examination, and/or retention of such records;
(d) failing to properly train the driver to safely operate commercial motor vehicles;
(e) failing to supervise the bus driver;
(f) failing to adequately inspect, maintain, and repair the bus;
(g) failing to monitor the bus driver;
(h) violating Federal Motor Carrier Safety Administration regulations;
(i) operating a bus which they knew or should have known was in an unsafe condition; and,
(j) failing to adhere to the safety practices prescribed by the Federal Motor Carrier Safety Administration Regulations and/or the Texas Commercial Motor Vehicle Handbook
