Lawsuit Filed Following ITC Terminal Fire

Spagnoletti Law Firm recently filed suit on behalf of a local worker who sustained serious injuries as a result of the fire and dangerous release of toxins during the fire at the Deerpark, Texas ITC Terminal in March 2019.   The Plaintiff, a security officer at a nearby facility, inhaled dangerous chemicals and smoke following the fire.  As a result of the dangerous chemicals that were breathed in, Plaintiff suffered multiple hospitalizations due to respiratory damage.  She continues to receive medical treatment.  The lawsuit brings claims against Pasadena Commodities International, LLC and PCI Nitrogen, LLC, the owner and operator of the facility at which she was working.  The lawsuit alleges:

Despite the dangerous chemicals and smoke in the air, Plaintiff was forced to work, without adequate respiratory and safety equipment during and following the fire. As a security officer at the plant, Plaintiff was required to work outdoors where she was exposed to, and inhaled dangerous smoke and toxic chemicals.

The lawsuit alleges all of the Defendants were negligent in the following ways:

(a) failing to provide proper and adequate equipment to perform the job;
(b) failing to test air quality at the facility to ensure it was safe for Plaintiff to perform her work;
(c) failing to take reasonable precautions for Plaintiff’s safety;
(d) failing to provide Plaintiff with a reasonably safe place to work;
(e) failing to provide Plaintiff a respirator and/or other safety equipment that would have been provided by a reasonably prudent company under the same or similar circumstances;
(f) failing to develop, implement, and maintain proper safety procedures and protocol regarding safe operations in the event of a fire of highly toxic and dangerous chemicals;
(g) failing to warn Plaintiff concerning the risks and dangers associated with the highly toxic and dangerous chemicals she was breathing.
