Lawsuit Filed for Injured Vessel Worker

by | Oct 29, 2020 | Civil litigation, Personal Injury

Spagnoletti Law Firm recently filed suit on behalf of an injured maritime worker who was severely hurt while performing work on a vessel, the West Capricorn.  At the time of the violent accident, the Plaintiff was cleaning a tank on the vessel, when he was hurt due to pressure build up in the hose that was being used.  The Plaintiff sustained severe and disabling personal injuries when he was thrown backwards onto the deck of the vessel.  The lawsuit has been filed against the owner and operator of the vessel, Seadrill Americas, as well as the employer of the Plaintiff’s supervisor on the vessel, Halliburton.

The lawsuit alleges the Companies were negligent in:

(a) failing to provide proper and adequate equipment to perform the job;
(b) failing to maintain the vessel and her appurtenances and/or equipment in a safe and reasonable state of repair;
(c) failing to take reasonable precautions for Plaintiff’s safety;
(d) failing to provide Plaintiff with a reasonably safe place to work, including failing to provide proper equipment and sufficient crew;

Claims are also brought for maintenance and cure benefits under the Jones Act, and for unseaworthiness of the vessel.  The Plaintiff is represented by Spagnoletti Law Firm attorneys Marcus Spagnoletti and Eric J. Rhine.
