Lawsuit Filed After Helicopter Refueling Accident on Offshore Platform

Spagnoletti Law Firm recently filed suit on behalf of an offshore platform worker who was severely injured on an offshore platform.  At the time of the accident, the Plaintiff was working as a scaffold supervisor on Occidental Petroleum’s Nansen spar platform in the Gulf of Mexico.  Our client was assisting with refueling a helicopter owned and operated by ERA Helicopters, when he slipped and fell.  The Plaintiff sustained severe and disabling personal injuries as a result.  The lawsuit has been filed against Occidental Petroleum, the owner and operator of the platform, and ERA Helicopters.

The lawsuit alleges Occidental was negligent in:

(a) failing to ensure the premises was free from hazards;

(b) failing to properly maintain the platform and/or ensure it was free from defect;

(c) failing to ensure the safety of workers aboard the platform;

(d) failing to perform all operations in a safe and work-like manner;

(e) failing to provide adequate equipment for the task at hand;

(f) failing to perform all operations in a safe and work-like manner;

(g) failing to properly plan and supervise the job;

(h) failing to adequately assess and mitigate risks before the job;

(i) failing to properly coordinate the work that was being performed;

(j) failing to exercise stop work authority; and,

(k) other acts and omissions that will be shown at the time of trial herein.

The suit alleges that ERA Helicopters was negligent in:

(a) failing to provide proper and adequate supervision of the work;

(b) failing to ensure the safety of workers performing work on the helicopter;

(c) failing to perform all operations in a safe and work-like manner;

(d) failing to take reasonable precautions for Plaintiff’s safety;

(e) failing to provide adequate equipment for the task at hand;

(f) failing to properly plan and supervise the job;

(g) failing to adequately assess and mitigate risks before the job;

(h) failing to properly coordinate the work that was being performed;

(i) failing to exercise stop work authority; and,

(j) other acts and omissions that will be shown at the time of trial herein.
