by | Feb 12, 2024 | Maritime Law, Personal Injury

A crew member was medically evacuated from the container ship ANTWERPEN EXPRESS on February 6, 2024.  According to reports, a crew member was showing symptoms of having sustained a stroke on the vessel.  At the time the vessel was near Guam.  The U.S. Coast Guard and U.S. Navy coordinated efforts to assist with a medical evacuation.  Additional details have not been released.

Ensuring rapid access to medical care for maritime workers who have been injured or fallen ill is not just a matter of health—it’s a critical legal concern that can significantly affect the outcome of compensation claims under maritime law. The unique and often hazardous conditions faced by those working at sea or in related maritime sectors make them particularly vulnerable to accidents and health issues. Immediate medical treatment not only provides the best chance for a full and speedy recovery but also establishes a documented record of the injuries or illness, which is essential for any legal proceedings. Maritime employers and operators have a duty to provide a safe working environment and to act promptly when incidents occur. Failure to secure prompt medical attention can exacerbate the situation, leading to more severe health outcomes for the worker and potentially greater liability for the employer.

For maritime workers and their families, understanding the importance of quick medical intervention is crucial. It serves as the foundation for any claims under the Jones Act, general maritime law, or the Longshore and Harbor Workers’ Compensation Act. An immediate medical evaluation not only pinpoints the cause and extent of the injuries but also links them directly to the maritime working conditions, which is a key element in establishing liability and securing appropriate compensation. Maritime law firms navigate these complex legal waters, advocating for the rights of injured workers to ensure they receive the medical care and compensation they are entitled to. In cases of maritime accidents or illness, time is of the essence. Securing legal representation early can help ensure that all procedural requirements are met, and crucial evidence is preserved, paving the way for a successful claim.

There have been a number of recent incidents involving vessels.  A crew member from a tugboat went overboard in the Gulf Intracoastal Waterway in Orange County, Texas on February 2, 2024.  A pilot was killed while trying to board the bulker ship NEW SIHAM on February 4, 2024.  A sailboat with three people on board capsized off the Coast of Georgia on February 6, 2024.  A commercial fishing vessel became grounded near Bodega Bay, California on February 9, 2024.  There was a collision between two vessels in Miami, Florida on February 11, 2024.

It can be dangerous to work in any industry when safety considerations are not taken seriously.  Safe offshore vessel owners and operators must ensure that their ships do not put the lives of hard working men and women at risk.  Safe companies must be proactive and take preventative measures, including regular maintenance and repairs, to also ensure that the environment is not impacted.

Even when a company has practices and procedures in place to prevent incidents like this, mishaps such as the one described above are cannot be completely eliminated.  All too often, human error and negligence are the reasons for these vessel collisions.  Whether it is due to poor judgment, a normalization of deviance from the proper procedures or a lack of proper rest and recovery, humans err and sometimes these errors result in the property damage, injury or death.  Operating modern sea vessels is not an inherently unsafe act as long as those responsible do so in such a manner that is not negligent. When the operation of sea vessels is conducted in a negligent manner, it does not take long for the situation to become dangerous.
