Jones Act Lawsuit Filed After Incident on Vessel

Spagnoletti Law Firm recently filed suit on behalf of a Jones Act seaman who was injured while working for R & R Boats.  During the incident, the vessel encountered rough seas after getting to an offshore platform.  Unable to transfer the crew change to the platform, the relief captain tied off via a mooring line.  The line snapped, and the vessel encountered big waves which struck the boat.  The relief captain was thrown around wheelhouse and sustained significant injuries as a result.  The lawsuit brings claims against R & R Boats, the owner of the Zachary Taylor, and EPL Oil & Gas arising out of the incident.  The lawsuit alleges that R & R Boats provided an unseaworthy vessel, and was negligent in:

(a) failing to provide proper and adequate equipment to perform the job;

(b) failing to maintain the vessel and her appurtenances and/or equipment in a safe and reasonable state of repair;

(c) failing to take reasonable precautions for Plaintiff’s safety;

(d) failing to provide Plaintiff with a reasonably safe place to work, including failing to provide proper equipment and sufficient crew;

(e) failing to provide proper and adequate lines for tying off of the vessel;

(f) failing to safely evaluate weather conditions.

The lawsuit alleges EPL Oil & Gas was negligent in:

(a) failing to provide proper and adequate lines for tying off of the vessel;

(b) failing to safely evaluate weather conditions;

(c) failing to take reasonable precautions for Plaintiff’s safety;

(d) failing to perform adequate safety meetings and analyses to identify and minimize the risk to Plaintiff and others;

(e) failing to assess the conditions on board the platform; and,

(f) other acts of negligence and/or omissions to be shown at trial herein.

The injured Plaintiff is represented by Marcus R. Spagnoletti and Eric J. Rhine.
