Fatal Crane Collapse at Florida Hospital Construction Site Kills Two Workers

by | Jun 5, 2025 | Construction Accident, Wrongful Death

Two workers were tragically killed on June 4, 2025, when a crane collapsed at the construction site of the new Cape Canaveral Hospital in Merritt Island, Florida. The incident is under investigation by both local authorities and the Occupational Safety and Health Administration (OSHA), as questions mount about the conditions that led to the deadly collapse.

The collapse occurred around 2:00 p.m. at the job site located on Borman Drive. Video from aerial footage revealed the crane had toppled onto a nearby vehicle, reportedly crushing the cab of a truck. Two trade workers—one employed by Baker Concrete and the other by a different subcontractor—were transported to the hospital but later died from their injuries.  The victims have been identified as Isael Martinez of Haines City and Hector Pozos of Kissimmee.  Our thoughts and prayers go out to those impacted by this incident.

At the time of the incident, the region had been experiencing severe weather, with wind gusts of up to 50 miles per hour recorded by the National Weather Service.   Authorities have not yet confirmed whether weather conditions directly caused the collapse. The construction site, part of a major $390 million hospital replacement project, is being managed by Gilbane Building Company.

Potential Causes and Liability

Crane accidents are among the most dangerous incidents that can occur on a construction site, often involving catastrophic structural failures or operator error. There are a number of risks involving severe weather on a construction project. In this case, possible contributing factors may include:

  • Improper anchoring or stabilization of the crane
  • Failure to follow protocols for operating in high-wind conditions
  • Mechanical failure or equipment defects
  • Lack of adequate weather monitoring or response planning

Construction contractors and site managers are responsible for enforcing safety protocols to prevent such tragedies. If negligence played a role—whether through faulty operation, improper maintenance, or failure to shut down during dangerous weather conditions—those entities may be held legally accountable.

Safety Oversight and OSHA’s Role

The Occupational Safety and Health Administration has jurisdiction over construction site safety and will lead the federal investigation into this incident. OSHA’s findings could determine whether safety violations occurred and if fines or penalties are warranted. OSHA may also issue safety recommendations to prevent future crane-related fatalities.

Legal Rights for Families of Deceased Construction Workers

When a construction worker is killed on the job, surviving family members may be entitled to compensation under applicable state and federal laws. In cases like this, where multiple contractors and potential equipment suppliers are involved, determining legal responsibility can be complex.

Wrongful death claims can provide compensation for:

  • Funeral and burial expenses
  • Loss of financial support and future earnings
  • Loss of companionship
  • Pain and suffering

In some cases, third-party liability claims may be pursued in addition to any available workers’ compensation benefits.
