A devastating chain-reaction collision on Interstate 40 near Tucumcari, New Mexico, claimed the life of one woman and injured several others on Sunday, May 25, 2025. The multi-vehicle crash involved two passenger vehicles and two commercial semi-trucks, and is currently under investigation by New Mexico State Police.
The crash occurred just after 8:00 a.m. on eastbound I-40 near milepost 343. According to officials, an eastbound semi-truck collided with the rear of a Nissan sedan. The force of that impact pushed the sedan off the roadway. The same truck then struck a Nissan SUV driven by Fauna Gutierrez, propelling it into the back of another semi-truck hauling a trailer. Tragically, Gutierrez sustained fatal injuries in the crash.
Three passengers—one in Gutierrez’s SUV and two in the Nissan sedan—were transported to a nearby hospital with injuries.
Possible Causes and Liability Considerations
Authorities have not yet released the cause of the crash, but early reports suggest that the initial rear-end collision by the semi-truck may have triggered the chain of events. Commercial truck drivers are required by law to maintain safe following distances and remain vigilant at all times—particularly on high-speed interstates.
When large trucks are involved in rear-end collisions, questions often arise regarding the driver’s alertness, speed, and whether proper braking procedures were followed. Fatigue, distraction, or mechanical failure may all be contributing factors that investigators will examine closely.
If it is determined that the truck driver or the trucking company failed to meet their duty of care, the surviving victims and the family of Fauna Gutierrez may have legal grounds to pursue claims for negligence.
The Dangers of Multi-Vehicle Collisions with Commercial Trucks
Highway crashes involving multiple vehicles and heavy trucks often have devastating outcomes. The massive size and weight of 18-wheelers mean that even low-speed impacts can cause serious damage, especially when passenger vehicles are caught between two commercial trucks.
In these types of crashes, determining fault can be complex and may involve several liable parties, including individual drivers, commercial carriers, and vehicle maintenance providers. A thorough investigation of vehicle logs, dash camera footage, and black box data will be essential.
Legal Rights After a Trucking Collision
Families who have lost a loved one in a trucking accident may be entitled to file a wrongful death lawsuit. Survivors who were injured can seek compensation for medical expenses, pain and suffering, lost wages, and other damages. In cases involving commercial vehicles, claims may also extend to the employer or the company that owned or maintained the truck.
An experienced trucking accident attorney can help gather the necessary evidence, determine liability, and pursue the maximum compensation available under the law.
