A devastating collision occurred late Friday night, July 25, 2025, in Hardin County, Texas, claiming the lives of four members of the same family. The crash involved a commercial 18-wheeler and a utility terrain vehicle (UTV), commonly referred to as a side-by-side.

Fatal Crash Near Silsbee

According to the Texas Department of Public Safety, the accident occurred around 11:30 p.m. on FM 92 near Jim Burns Road—just north of Silsbee and south of Fred. Preliminary reports indicate that the UTV entered the roadway from Jim Burns Road and was struck by a southbound 18-wheeler.

Five individuals were riding in the UTV at the time. Four victims—46-year-old Otis Smart, 33-year-old Melissa Smart, 26-year-old Triston Smart, and 63-year-old Terry Smart, all of Kountze—died at the scene. A fifth passenger, 30-year-old Kali Smart, suffered life-threatening injuries and was airlifted to Memorial Hermann Hospital in Houston.

The driver of the commercial vehicle, identified as 34-year-old Arthur Jones of Houston, sustained non-life-threatening injuries and was transported to CHRISTUS St. Elizabeth Hospital.

Responsibilities of Commercial Truck Drivers

Operators of commercial motor vehicles are held to elevated safety standards under both state and federal law. Due to the size and force of 18-wheelers, even momentary lapses in attention or awareness can have devastating consequences for others on the road.

Truck drivers must exercise constant vigilance to detect and respond to smaller or slower-moving vehicles. Key responsibilities include:

  • Maintaining a safe speed and following distance at all times

  • Keeping a proper lookout for vehicles entering from side roads, driveways, or intersections

  • Adjusting for reduced visibility at night or in low-light conditions

  • Anticipating the possibility of unexpected roadway entries in rural or residential areas

  • Remaining attentive and alert to all potential hazards within the vehicle’s path

Trucking companies also have a duty to ensure their drivers are adequately trained, medically qualified, and fit for duty—especially when operating in areas where unexpected encounters with smaller vehicles or pedestrians may occur. Failure to meet these obligations can result in serious and catastrophic injuries or loss of life.

Legal Options for Families After a Fatal Truck Accident

In the wake of such tragedies, surviving family members may have legal rights to pursue a wrongful death claim against the parties at fault. These cases may involve:

  • The driver of the commercial vehicle
  • The trucking company responsible for training, supervision, or maintenance
  • Potential third parties responsible for road conditions or signage

Available compensation may include economic damages like lost income and funeral expenses, and non-economic damages such as loss of companionship and emotional suffering.

Our team investigates accident reconstruction, black box data, driver logs, and more to determine fault and build strong cases on behalf of victims’ families.
