Boat Capsizes Near Sabine Pass Jetty, Two Rescued by Jefferson County Deputies

by | Aug 14, 2025 | Maritime Law

A boating emergency unfolded Friday, August 8, 2025, in Sabine Pass, Texas, when a small vessel capsized inside the jetty wall after encountering the wake of a passing ship. Two people—a 57-year-old man and an 83-year-old woman—were thrown into the water. Fortunately, both were wearing life jackets and were rescued unharmed thanks to the swift response of the Jefferson County Sheriff’s Office (JCSO) Marine Division.

The capsizing occurred around 8:00 a.m. A local fishing guide spotted the overturned vessel and alerted the Marine Division. Deputies located the pair near the Louisiana Cut in shallow water.  Once the passengers were located, the vessel was towed back to the causeway bridge ramp.

This incident highlights just how quickly conditions on the water can turn hazardous—and how crucial training, equipment, and quick decision-making can prevent a fatal outcome.

Possible Causes of a Boat Capsizing

Capsizing is one of the most dangerous events that can occur on the water. Even experienced boaters can fall victim to sudden hazards. While investigators have not yet released an official cause, several common risks may have contributed:

  • Wake turbulence from Larger Vessels: The wake from a passing ship can easily destabilize smaller boats, especially in confined areas like jetty entrances.
  • Improper Weight Distribution: Shifting cargo or passengers can throw off a vessel’s center of gravity, increasing the risk of tipping.
  • High or Cross Waves: Waves hitting from the side, or multiple directions, can cause instability, particularly for flat-bottomed or lightly loaded boats.
  • Mechanical Failures: A sudden loss of power, steering failure, or bilge pump malfunction can reduce a vessel’s ability to recover from a sudden jolt.
  • Poor Weather Conditions: Rapid changes in wind or visibility can combine with other factors to increase the likelihood of vessel accidents or recreational boating incidents.
  • Water Intrusion: Leaks, poor hull condition, or unsecured hatches may allow water to flood the boat, especially when compounded by waves or swells.

These risks are present on all types of waterways, but narrow passages like jetties or harbor entrances increase exposure to wake turbulence and sudden swell action.

Understanding Your Legal Rights After a Boating Accident

Even in non-fatal incidents, capsizing can cause serious harm, loss of property, or lasting trauma. In more severe cases, such as those involving serious and catastrophic injuries, maritime law offers multiple pathways for recovery—especially when another party’s negligence or unsafe operation contributed to the event.

For example, if a commercial vessel’s wake led to a recreational boat’s capsize, victims may be able to pursue a personal injury claim depending on factors like navigation violations or gross negligence in operating within congested waterways. Maritime law allows recovery for:

If fatalities occur, surviving family members may be eligible to pursue a wrongful death claim under general maritime law or the Death on the High Seas Act (DOHSA), depending on where the incident took place.

What Should You Do After a Boat Capsizes?

  1. Prioritize Safety – Wear a life jacket and stay with the boat if possible.
  2. Call for Help – Use a marine radio or mobile device to request assistance.
  3. Document the Scene – If you’re safe, take note of weather, wave patterns, or any contributing vessel activity.
  4. Seek Immediate Medical Attention – Hypothermia, shock, and other injuries may not be immediately apparent.
  5. Speak With a Maritime Attorney – An experienced boating accident attorney can assess your legal options and help preserve critical evidence.
