Worker Killed by Falling Metal Plate at El Mirage BNSF Site

by | Aug 29, 2025 | Firm News

On August 28, 2025, in El Mirage, Arizona, a contract worker was fatally injured at the BNSF Automotive Distribution Center near US-60 and Thompson Ranch Road. Police say crews arrived just after 9 a.m. and found the man trapped under a metal plate weighing in excess of 1,000 pounds. He was unresponsive and was pronounced dead at the scene. Officials said the worker was a contractor performing work on BNSF property.  The investigation is ongoing.

How incidents like this happen: Heavy-object strikes on construction and industrial sites are often tied to preventable hazards—improper rigging or lifting, inadequate exclusion zones, unstable staging, or uncontrolled energy during maintenance. These risks fall squarely within common construction equipment hazards and “struck-by” scenarios, including falling debris. When machinery is serviced or repositioned, strict lockout/tagout procedures help ensure components can’t move unexpectedly.

What investigators typically review: Agencies and forensic experts will document the lift or handling plan for the plate, load path and communication, barricades or spotters, and any change made in the field. They’ll examine rigging gear, anchors, and lifting devices; check ground conditions and equipment stability; and pull maintenance and inspection records. Preserving photos, video, and job logs is critical—see what counts as key evidence in civil cases.

Potential claims and compensation: If the decedent was an employee of a contractor, the family may have a workers’ compensation claim for statutory benefits. Depending on the facts, additional third-party liability claims can target non-employer entities—such as site owners, general contractors, subcontractors, or equipment manufacturers—when their negligence or a product defect contributed. Eligible family members may also pursue a wrongful death claim seeking legally recognized losses, including economic damages (funeral costs and lost financial support) and human losses like loss of companionship. Timelines are strict, so it’s important to understand the applicable statute of limitations.
