DPS Identifies Woman Killed in Stop-Sign Collision in Bailey County, Texas

by | Oct 16, 2025 | Auto Accident, Wrongful Death

On October 15, 2025, the Texas Department of Public Safety said Ramirez Martinez, 31, of Muleshoe, died at the scene of a two-vehicle crash in Bailey County, Texas. DPS reports indicate Ms. Martinez was driving south on County Road 153 and entered the intersection at FM 1760, which is stop-controlled. A westbound vehicle on CR 153 then struck the left-rear of Ms. Martinez’s car. No additional injury information was released as of Wednesday afternoon. The DPS investigation is ongoing.

Right-of-Way, Fault, and Texas Comparative Negligence

Rural, stop-controlled intersections can be deceptively complex: sight-lines, approach speeds, and time-to-arrival all shape what drivers reasonably perceive before entering the roadway. Even when one driver appears to “pull out,” investigators still evaluate the other vehicle’s speed, lookout, and lane position to determine how responsibility is shared under Texas’s comparative negligence rules. Those rules can reduce or bar recovery depending on each party’s percentage of fault. In any civil claim, plaintiffs still bear the burden of proof to establish negligence with admissible evidence.

What to Preserve in the First 7 Days (So Key Facts Aren’t Lost)

Early evidence often decides rural intersection cases. Families and representatives should secure crash-scene photos, roadway measurements, and nearby camera footage (homes, barns, businesses). Vehicle modules and phones can hold speed/position data; preserving those sources promptly prevents automatic overwrites. A formal preservation letter puts insurers and other parties on notice to keep EDR downloads, repair estimates, and witness information. See the kinds of evidence that commonly move these cases forward.

Rights of Surviving Families

Texas law allows eligible relatives to bring a wrongful death claim seeking compensation for loss of financial support, companionship, and mental anguish. The estate may also pursue claims connected to funeral expenses and any conscious pain and suffering before death. Because liability can turn on seconds of timing and feet of distance at a stop-sign crash, prompt guidance helps align the investigative record with civil standards.
