Motorcyclist Killed in Crash at Magnetic Street and Hercules Avenue in El Paso

by | Nov 28, 2025 | Auto Accident, Wrongful Death

A deadly motorcycle crash in Northeast El Paso on November 26, 2025, has once again highlighted the risk of motorcycle accidents in El Paso’s busy neighborhoods and arterial streets. El Paso Police Department investigators report that the collision occurred around 1:04 p.m. near the intersection of Magnetic Street and Hercules Avenue, an area where turning traffic, lane changes, and visibility issues can create significant danger for riders.

According to authorities, 26-year-old John Paul Forero Moya, a Northeast El Paso resident, was riding his motorcycle northbound on Magnetic Street. At the same time, a 2014 Nissan Murano driven by 37-year-old Juan Jose Flores Orozco of Socorro was traveling south on Magnetic and began a left turn onto Hercules Avenue. As the Nissan crossed the northbound lane, the motorcycle struck the vehicle in the intersection. Moya suffered fatal injuries and tragically was pronounced dead at the scene.

The impact reportedly caused a fire involving the motorcycle, and traffic in the area was disrupted while first responders secured the scene. The Special Traffic Investigations unit is continuing to reconstruct the collision and determine what combination of speed, visibility, lane position, and driver decision-making led to this tragedy. Crashes like this highlight the risk of intersection accidents and left turn accidents involving motorcycles that are known to be especially dangerous for riders across Texas.

El Paso’s unique topography, traffic mix, and weather create additional risk of motorcycle accidents in El Paso, especially along major corridors where passenger vehicles often turn across oncoming motorcycles.

How Motorcycle Collisions Like This Happen

Investigators typically look at a range of factors when a motorcycle and a passenger vehicle collide in an intersection. Common issues include:

  • A turning driver misjudging an oncoming motorcycle’s speed or distance
  • A driver failing to properly scan for a smaller motorcycle profile
  • Line-of-sight problems created by traffic, curves, or roadside features
  • Potential blind spots in larger vehicles like SUVs
  • The well-documented risks of motorcycle accidents when drivers do not yield the right-of-way

In many fatal motorcycle collisions, the rider has little to no opportunity to brake or swerve before impact. The Special Traffic Investigations unit may review scene measurements, roadway design, weather conditions, and any available video or evidence to determine whether driver error, speed, or other violations contributed to this crash.

Injuries and Losses in Deadly Motorcycle Crashes

Motorcycle crashes frequently result in severe trauma, even when the rider is wearing protective gear. Families dealing with a fatal collision are often confronting the kinds of common injuries that can include internal damage, traumatic brain injury, spinal trauma, or multiple fractures.

When a rider does not survive, Texas law allows certain family members to pursue a wrongful death action. A claim may seek compensation for:

  • Funeral and burial expenses
  • The loss of the rider’s financial support and household contributions
  • Emotional harm, grief, and non-economic damages suffered by surviving family members

Because Texas follows a comparative negligence system, insurers may try to argue that the motorcyclist was partly at fault to reduce what they pay. It is important for families to consult with a motorcycle accident lawyer to understand their rights before giving statements or accepting any early settlement offers.

Avoiding Common Legal Mistakes After a Fatal Motorcycle Accident

After a deadly crash, families are often overwhelmed by grief, medical bills, and sudden contact from insurance companies. In that difficult period, it is easy to make common legal mistakes that can weaken a future claim, such as:

  • Providing recorded statements before understanding the full scope of the case
  • Signing releases that allow broad access to medical or personal records
  • Accepting quick offers that do not reflect long-term financial and emotional losses
  • Waiting too long to speak with a motorcycle accident lawyer, allowing key evidence to disappear

An experienced attorney can help families navigate the litigation process, protect their rights, and pursue the full compensation they are entitled to under Texas law.
