A fatal 18-wheeler accident occurred on March 13, 2026 in Brookshire, Texas after a commercial truck allegedly failed to control its speed and triggered a chain-reaction collision that ultimately struck an ATV rider. Authorities say the crash happened at FM 362 and Garvie Road and resulted in the death of 65-year-old Brookshire resident Ernest Ray Kelley.
According to the Texas Department of Public Safety, the collision unfolded around 1:00 p.m. when traffic was slowing near the intersection. Investigators say a Mercedes traveling northbound on FM 362 was preparing to turn left onto Garvie Road. A Ford F-250 pickup traveling behind the Mercedes slowed and came to a stop.
At that point, a Freightliner tractor-trailer traveling northbound on FM 362 reportedly failed to control its speed and rear-ended the Ford pickup. The impact caused the Ford to spin into the southbound lanes of FM 362, where it struck Kelley’s Tracker Pro ATV.
Emergency responders arriving at the scene pronounced Kelley dead at the location of the crash. The driver and passenger in the Ford F-250 were transported to a nearby hospital for treatment. Authorities said the 18-wheeler driver and passenger and the Mercedes driver were not injured.
Officials reported that the truck driver was cited for failure to control speed. The crash remains under investigation by DPS and the Waller County Sheriff’s Office.
Chain-Reaction Collisions Involving Commercial Trucks
Crashes involving large commercial trucks frequently lead to multi-vehicle collisions. When a tractor-trailer strikes a vehicle from behind, the force of the impact can push that vehicle into adjacent lanes or other traffic.
These types of incidents often develop into a rear-end collision that triggers a secondary crash involving additional vehicles. In this case, the pickup truck that was struck by the commercial truck spun into oncoming traffic and collided with the ATV rider.
Commercial trucks can weigh as much as 80,000 pounds when fully loaded. Because of that massive weight, the force generated during a truck crash can easily push other vehicles into new lanes of traffic or into other vehicles nearby.
When chain-reaction crashes occur, people who were not initially involved in the first impact can suffer devastating consequences.
Investigating the Truck Crash
After a serious trucking collision, investigators typically analyze the scene carefully to determine how the crash unfolded. Officers will collect information and prepare an official accident report documenting the vehicles involved, roadway conditions, and statements from drivers and witnesses.
Truck crashes also involve additional evidence that may not exist in ordinary vehicle collisions. Investigators frequently review black box data recorded by the truck’s electronic control module. This information can reveal the vehicle’s speed, braking activity, and other operating conditions in the moments before the crash.
In addition, trucking records such as driver logs may be examined to determine how long the driver had been on the road before the collision.
These records are important because federal safety rules, including hours of service regulations, limit how long truck drivers can operate their vehicles before taking mandatory rest breaks.
FMCSA violations may contribute to serious crashes and can be important in determining responsibility.
Driver Fatigue and Trucking Safety
One potential factor in many commercial truck collisions is driver fatigue. Long hours behind the wheel can impair reaction time and reduce a driver’s ability to recognize slowing traffic ahead.
If a truck driver is tired or distracted, they may not react quickly enough when vehicles ahead begin to slow or stop. Because of the size and weight of tractor-trailers, even a brief delay in braking can result in a serious collision.
Investigators may examine whether the driver had been on duty for extended periods or whether fatigue played any role in the crash.
Liability in Trucking Collisions
Truck crash cases can involve several potential sources of liability. In addition to the driver, the trucking company may also bear responsibility for unsafe practices or failures in oversight.
Evidence of safety violations may include improper training, inadequate supervision, or violations of federal regulations. When safety failures contribute to a crash, those responsible may face legal consequences.
These situations can lead to trucking company liability if company policies or actions played a role in causing the crash.
Vulnerability of ATV Riders in Roadway Collisions
All-terrain vehicles offer far less protection than passenger vehicles when crashes occur on public roadways. When an ATV rider is struck by a larger vehicle such as a pickup truck or commercial truck, the rider is exposed to direct impact forces.
Because of this vulnerability, ATV collisions frequently result in serious and catastrophic injuries or death.
Victims involved in these incidents may suffer severe trauma including traumatic brain injury or spinal injury due to the force of the collision.
Legal Claims After a Fatal Truck Crash
When a fatal crash occurs, surviving family members may have the right to pursue a wrongful death claim.
These claims allow families to seek compensation for the financial and emotional losses caused by the death of a loved one. Potential damages may include economic damages such as funeral expenses, medical costs, and lost income.
Families may also pursue non-economic damages related to emotional suffering, grief, and loss of companionship.
