Laredo Truck Driver Killed in Workplace Accident in Kingsville

by | Mar 14, 2026 | Auto Accident, Industrial Accident, Wrongful Death

A fatal workplace injury occurred on March 13, 2026 at an AEP Texas facility in Kingsville when a 63-year-old truck driver from Laredo became pinned beneath a trailer while preparing to leave the facility yard. Authorities say the incident happened shortly after the driver had completed a delivery and was making preparations to depart the site.

According to the Kingsville Police Department, emergency responders were dispatched at approximately 10:33 a.m. to the AEP Texas facility located on East Corral Avenue after a 9-1-1 call reported a serious incident involving a truck driver. Officers, firefighters, and EMS personnel arrived to find the driver deceased at the scene.

Investigators identified the man as Cervelio Garcia Guzman, 63, of Laredo. Police reported that Guzman had delivered equipment to the facility in a tractor-trailer and was preparing the trailer to leave the yard when he became pinned beneath it. Authorities say an AEP employee discovered him approximately five minutes later.

Justice of the Peace Precinct 1 Judge Gonzalez ordered an autopsy. The incident remains under investigation.

Hazards Associated With Tractor-Trailer Operations in Industrial Facilities

Truck drivers who deliver equipment or materials to industrial sites frequently work around heavy equipment, trailers, and loading infrastructure. These environments can pose serious risks, particularly when drivers must manually inspect or adjust equipment before leaving a facility.

Incidents involving trailers can occur during coupling and uncoupling procedures, landing gear adjustments, or while checking cargo security. When a driver must position themselves beneath or near a trailer, any unexpected movement or equipment failure can create extremely dangerous conditions.

In some cases, these incidents result in crush injuries when a person becomes trapped between heavy components or pinned under industrial equipment. Because trailers and other commercial vehicle components can weigh thousands of pounds, the forces involved are often fatal or cause catastrophic trauma.

Industrial worksites must maintain strict safety procedures to minimize these risks.

Workplace Safety Responsibilities at Industrial Facilities

Facilities that receive deliveries from commercial trucks must ensure that their yards and loading areas are maintained in a reasonably safe condition for visiting drivers. Drivers often enter unfamiliar environments where they may not be aware of potential hazards.

Worksite operators may have responsibilities related to traffic control, safe loading zones, equipment maintenance, and communication with visiting drivers. If unsafe conditions exist within the yard, they can create dangerous situations for drivers performing routine tasks around their vehicles.

In certain circumstances, investigators may examine whether safety procedures were followed and whether additional precautions could have prevented the accident. These questions may become important when evaluating third-party liability for incidents that occur at industrial facilities.

Investigating a Fatal Industrial Accident

When a fatal workplace incident occurs, investigators will typically examine the circumstances surrounding the event in detail. Law enforcement officers and workplace safety officials often review the scene, inspect equipment, and speak with witnesses.

An official accident report will typically document the initial findings of responding authorities, including statements from witnesses and observations about the environment where the incident occurred.

In addition to law enforcement reports, investigators may review workplace safety records, maintenance logs, and operational procedures to determine whether any safety rules were violated.

Preserving evidence following a fatal accident can be critical. In some cases, attorneys may issue a preservation letter to ensure that important documents, surveillance footage, and equipment records are not destroyed during the investigation.

Evidence That May Be Examined After a Workplace Fatality

Investigators reviewing the Kingsville incident may look at several types of evidence to determine how the accident occurred.

Important evidence in workplace accident cases may include:

  • surveillance camera recordings from the facility yard
  • witness statements from employees or other drivers
  • maintenance records for the trailer and equipment
  • safety procedures governing loading areas
  • inspection records for the trailer involved

Security footage or surveillance video may help investigators determine how the driver became pinned beneath the trailer and whether any equipment movement or operational issue occurred.

Witness accounts from employees working nearby may also play an important role in reconstructing the events leading up to the incident.

Determining the Cause of the Accident

Fatal workplace incidents often require careful analysis to determine what actually caused the injury. Establishing causation can involve examining mechanical equipment, workplace procedures, and the actions of individuals involved in the event.

Experts may analyze whether the trailer’s equipment functioned properly and whether any mechanical or operational failures contributed to the accident. Safety specialists may also evaluate whether appropriate procedures were in place for drivers performing equipment checks within the facility.

In complex cases, attorneys may rely on an expert witness to analyze the accident and explain whether industry safety standards were followed.

Legal Claims After a Fatal Workplace Accident

When a worker dies in an industrial accident, surviving family members may have the right to pursue legal claims related to the loss.

A wrongful death claim may allow family members to seek compensation for the loss of financial support, funeral expenses, and other damages resulting from the death of their loved one.

In addition, a separate survival claim may be brought on behalf of the deceased person’s estate to recover damages that the individual could have pursued had they survived the accident.

These claims may include compensation for economic damages such as lost wages and financial contributions to the household. Families may also seek non-economic damages related to emotional loss and the absence of a loved one.

Workplace accident cases can involve complicated legal questions, especially when multiple companies or contractors operate within the same facility.
