Man Killed in New York Construction Accident Involving Forklift

by | Sep 27, 2025 | Construction Accident, Wrongful Death

A construction worker was killed on September 25, 2025, in Baldwin, New York.  Reports indicate the worker was crushed between a tractor-trailer and a forklift while unloading pallets of building material at a job site on Grand Avenue. Nassau County police confirmed that he was transported to a nearby hospital, where he died. The Nassau Homicide Squad and OSHA are leading the investigation.

How Forklift Accidents Can Happen

Forklifts are critical on construction projects, but their size, weight, and limited visibility create dangers when they move in close quarters with trucks, trailers, and workers on foot. OSHA regularly cites forklifts as one of the top causes of serious and fatal accidents. Hazards often include:

  • Poor visibility and blind spots. Operators may not see workers until it is too late, a factor tied to forklift blind spots and collisions in tight delivery zones.
  • Tip-over or rollover risks. Uneven terrain, shifting loads, or sharp turns can cause a tip-over accident or other instability events.
  • Mechanical failures. Inadequate upkeep, including defective hydraulics or defective equipment, can lead to sudden loss of control.
  • Crush and pinning incidents. Workers are at risk of devastating crush injuries when caught between a forklift and another vehicle, wall, or structure.
  • Improper site management. When staging areas are crowded or traffic flow is unmanaged, the chances of a warehouse accident or pedestrian strike increase.

Each of these hazards shows why strong supervision and awareness of construction zone hazards are vital.

Investigation Focus

In this case, investigators will likely examine:

  • The forklift’s maintenance history and whether it had known defects.
  • Trailer positioning, chocking, and sequencing of unloading.
  • Use of spotters, signage, and restricted access zones.
  • Compliance with OSHA standards and site-specific traffic plans.

Documents such as inspection logs and operator certifications will become crucial evidence if litigation follows.

Next Steps for Families

For families facing sudden loss, early steps matter. A tailored preservation letter can secure forklift service records, delivery logs, and any surveillance footage. In addition to possible workers’ compensation benefits, families may also pursue third-party liability claims if a contractor, equipment supplier, or delivery company contributed to the unsafe conditions.
